Terms of Use Agreement

Welcome to PiggyBankInsurance.com ("Site"). By using this Site, you agree to be bound by these Terms of Use ("Agreement") and our Privacy Policy ("Policy"). This Site is owned, controlled and operated by RetireMax Corporation, an Illinois independent insurance agency and reserves the right to revise this Agreement at any time and for any reason, without notice.

For the purposes of this Agreement, “you” or “your” means the person(s) using our Site, and/or the facilities or services of RetireMax. By continuing to use our Site, you acknowledge that you have read this Terms of Use Agreement and agree without limitation or qualification to be legally bound by this Agreement. You also agree to be bound by any such revisions and should therefore periodically visit and print the latest version of this Agreement for your records. For your information, the date of the last revision to this Agreement is posted at the top of this page. If you do not agree with any of these Terms of Use, please do not use our Site.

1. TERMS OF USE AGREEMENT TO CONTRACT ELECTRONICALLY

You agree that this electronic Terms of Use Agreement, combined with your accessing and using our Site has the same legal force and effect as a written contract with your written signature and satisfies any laws that require a writing or signature. You agree not to challenge the validity, enforceability, or admissibility of this Agreement on the grounds that it was electronically transmitted or authorized. 2. CONSUMER INFORMATION SECURITY POLICY

The RetireMax Consumer Information Security Policy, hereby incorporated by reference into this Agreement, explains the policy applicable to the information that is collected through our Site, received directly from you or transmitted to or from third parties.

3. DISCLOSURE OF USE OF CONSUMER REPORTS

To provide you with the most accurate and lowest price quotes in the marketplace, our Property and Casualty partner insurance companies use credit-based consumer report information in order to determine eligibility and insurance premiums. This information is obtained from an independent third-party consumer reporting agency. By submitting your information, you acknowledge and agree to authorize RetireMax and its employees, agents and partner insurance companies to run a credit-based consumer report on you and all individuals requesting insurance price quote estimates.

4. MINORS

RetireMax does not intentionally target anyone under the age of 16. Our Site, services and/or products are not directed toward people under the age of 16, nor do we knowingly collect information from individuals under the age of 16. Individuals between the ages of 16 and 18 are granted permission to use our Site only with the permission of their parent or guardian.

5. LINKS TO THIRD PARTY SITES

Our Site contains links to third party web sites (“Third Party Sites”). RetireMax does not endorse and has no control over the content on Third Party Sites. RetireMax makes no warranties or representations about the content of, any services and/or products offered by, or the intellectual property compliance of, such Third Party Sites. You further acknowledge and agree that RetireMax is not responsible or liable, either directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with Third Party Sites. Please take the time to read the privacy, terms of use and security policies of these Third Party Sites before using them.

6. LICENSE

• (a) License Grant. RetireMax is the author and/or authorized sublicensor of certain materials owned and created by RetireMax or RetireMax’s licensors. RetireMax grants you a non-transferable, non-exclusive limited license to use the information, images and other content contained on its Site (the "Materials"), solely for internal use by your business or for your own personal use, only with one central processing unit at any one time. You may not copy, reverse engineer, translate, port, modify or make derivative works of the Materials. You may not rent, disclose, publish, sell, assign, lease, sublicense, market, or transfer the Materials or use them in any manner not expressly authorized by this Agreement. You shall not derive or attempt to derive the source code, source files or structure of all or any portion of the Materials by reverse engineering, disassembly, decompilation or any other means. You shall not use the Materials to operate a service bureau or for any other use involving the processing of data of other persons or entities. RetireMax and/or RetireMax's licensors retains all ownership rights in the Materials. The Materials are copyrighted and may not be copied, even if modified or merged with other Materials. You shall not alter or remove any copyright or trademark notice or proprietary legend contained in or on the Materials. You agree not to remove any proprietary rights notices of RetireMax and/or its licensors from the Materials.
• (b) Reservation of Rights. RetireMax reserves any rights not expressly granted herein.
• (c) Restrictions. The Materials do not include the design or layout of the web pages generated by this server. Elements of these web pages are protected by trade dress and other laws and may not be copied or imitated in whole or in part. No logo, graphic, sound or image from any of the web pages generated by this server may be copied or retransmitted unless expressly permitted by RetireMax.

7. NO WARRANTY

RETIREMAX AND/OR ITS LICENSORS, EMPLOYEES, AND AGENTS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE MATERIALS PUBLISHED ON THIS SERVER FOR ANY PURPOSE. THE MATERIALS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. YOU ASSUME THE ENTIRE RISK OF LOSS IN USING THE MATERIALS AND THE INTERNET GENERALLY. THE MATERIALS ARE COMPLEX AND MAY CONTAIN NON-COMFORMITIES, DEFECTS OR ERRORS. RETIREMAX AND/OR ITS LICENSORS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE MATERIALS, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. YOUR USE OF OUR SITE IS AT YOUR SOLE RISK.

8. LIMITATION OF LIABILITY

IN NO EVENT SHALL RETIREMAX AND/OR ITS LICENSORS, EMPLOYEES, AND AGENTS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS OR THE INABILITY TO USE DATA, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE MATERIALS, PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR ANY OTHER INFORMATION AVAILABLE FROM THIS SERVER. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

9. GENERAL LEGAL PROVISIONS

• (a) Trademarks. Products and/or services referenced herein are protected by either trademarks or registered trademarks of RetireMax. Other product and company names mentioned herein may be protected by the trademarks of their respective owners. You acknowledge and agree that our Site and Materials are protected by copyright, trademark, patent and other proprietary rights and laws. Except for the limited, non-exclusive rights and license granted herein, nothing in this Agreement confers to you, whether by implication, estoppel or otherwise, any license, title, or ownership of or to our Site and/or Materials.
• (b) Errors and Corrections. The Materials published on this server could include technical inaccuracies and/or typographical errors. RetireMax and/or its licensors may make improvements and/or changes in the Materials at any time.
• (c) Termination. At any time and without prior notice, RetireMax may immediately terminate your access to our Site for: (1) breach of this Agreement; (2) requests by law enforcement or other government agencies; (3) discontinuance or Material modification to our Site (or any part thereof); and/or (4) unexpected technical or security issues or problems. You agree that termination for cause is at RetireMax’s sole discretion and RetireMax is not liable to you or any third party for termination of your access to our Site.
• (d) Indemnification. You agree to defend, indemnify and hold RetireMax, its affiliates and their respective employees, agents, directors, partners, contractors, officers, trustees, licensors and other third parties assisting in the operation of our Site, harmless from and against all claims, liabilities and expenses (including attorneys' fees) that may arise from your use of our Site and/or Materials, violation of the rights of others and/or breach of this Agreement.
• (e) Applicable Law and Jurisdiction. Neither RTMX nor its partner companies or affiliates make any representation that this Site and Content are appropriate or available for use in locations outside the United States. Those who choose to access this Site from other locations are responsible for compliance with any applicable local laws and any applicable laws regarding the transmission of technical data exported from the United States of the country in which you reside.
• (f) International Use. Neither RetireMax nor its partner companies make any representation that our Site and Materials are appropriate or available for use in locations outside the United States. 10. REGISTERED SELLER OF INSURANCE PRODUCTS

RetireMax Corporation is a registered Illinois independent insurance agency licensed to sell Property and Casualty and Life and Health insurance products. For those states we are not yet licensed to do business in, we have partnered with InsureMe.com, an affiliate Third Party Site and other Third Party Sites that may help consumers find multiple competitive insurance rates through a network of local state insurance agents.

You acknowledge and agree any and all insurance price quote estimate(s) provided to you by RetireMax whether by U.S. mail or by electronic mail in no way signifies the issuing, binding or contracting of any insurance coverage. You also acknowledge and agree the estimate(s) provided in no way signifies any type of proof of insurance coverage.
